In response to your press release dated August 29, 2024, regarding the Joint Parliamentary Committee's call for suggestions on "The Waqf (Amendment) Bill, 2024." As a concerned Indian citizen who has reviewed this bill, I firmly believe it should be entirely rejected.
It is important to clarify that the issues presented in this bill cannot be resolved through selective amendments. Therefore, this letter does not focus on specific sections, as the fundamental premise of the bill warrants outright rejection.
Upon detailed examination, several key concerns have emerged that necessitate discarding this bill:
1. Purpose and Consequences for Waqf Properties: The proposed amendments appear aimed at revoking the Waqf status of many properties and diminishing the administrative authority of the Mutawallis (caretakers).
2. Preservation of Sacred and Charitable Use: Waqf properties, originally private assets legally acquired and dedicated by their owners (Waqif) for religious purposes, possess deep religious and charitable importance under Shariah law. The suggested amendments threaten to undermine this sanctity.
3. Lack of Comprehensive Stakeholder Consultation: The bill has been introduced without sufficient engagement with critical stakeholders, including Muslim scholars, Waqf boards, and the broader Muslim community, which weakens the democratic process by excluding those directly affected.
4. Constitutional Violations: The Constitution guarantees the right to religious freedom and the autonomy to manage religious affairs. The centralization of control over Waqf properties in the bill contradicts these constitutional rights and risks setting a harmful precedent for further encroachment on minority religious rights.
5. Addressing Mismanagement and Corruption: The mismanagement and misuse of Waqf properties are primarily due to corruption and abuse of power by those in positions within Waqf boards. These issues should be tackled by eliminating corruption and ensuring strict penalties for those who exploit their authority.
Given these concerns, we urge the complete REJECTION of THE WAQF AMENDMENT BILL 2024 and recommend that the committee focus on measures to combat corruption and misuse of power within Waqf boards.
